Terms of Service
Website and initial session policies for Nivya Portraits.

These terms describe the public photography website, inquiries and initial session policies of Bhavya Dalwadi, operating Nivya Portraits as a sole proprietorship. Our photographer is known publicly as Bhavya. Client accounts, online booking, website payments and the existing Nivya private-gallery portal are not currently available.
Website And Inquiries
You may use this website to learn about our services and send an inquiry. Do not attempt unauthorized access or interfere with normal operation. Submitting an inquiry does not reserve a date, confirm a session or guarantee availability. Booking confirmation is handled manually through direct written confirmation from the studio.
Pricing And Session Confirmation
Portrait Sessions start at $375; other session offerings have their separately published starting prices. Final scope, price, availability, payment expectations, delivery arrangements and applicable usage rights are confirmed in writing before you make a binding commitment. We provide the applicable session policies before confirmation; specific agreed details belong in that written session agreement. Sending an inquiry is not an electronic signature or click-to-accept session contract.
Payment
Cash is preferred, and alternative payment methods may be discussed individually. There is no mandatory deposit for the initial workflow. Full payment is due on the photoshoot day, with payment expectations confirmed in writing. Payments and receipts are managed manually; this website does not collect payments.
Rescheduling
If you voluntarily request a reschedule at least 48 hours before the session, one voluntary reschedule is free. Requests inside 48 hours are considered case by case. Weather affecting an outdoor shoot qualifies for a free reschedule. Weather-related reschedules initiated or approved by the photographer, and photographer-initiated reschedules or cancellations, do not count against your one free voluntary reschedule. We handle illness and emergencies flexibly, case by case. Every rescheduled date is subject to studio availability; these policies do not promise unlimited voluntary reschedules.
Cancellation And Refunds
There is no client cancellation fee when no payment has been collected. Any prepaid amounts are handled according to the terms expressly agreed with you and applicable law; prepayment is not automatically a non-refundable retainer. If the photographer cancels, you may choose a free reschedule, subject to availability, or a full refund of payments received. Any other prepaid-payment or refund circumstances must be clarified in writing before payment or a binding commitment.
Gallery Delivery
Edited photographs are delivered through a separate password-protected client gallery using Pixieset for the initial workflow. We confirm the applicable access, download and delivery arrangements before client confirmation, including any agreed timing or gallery availability period. No fixed turnaround or expiration period is established by these website terms. The existing Nivya client-gallery portal remains disabled pending its separate release.
Copyright And Personal Use
The photographer retains photograph copyright unless otherwise agreed in writing. Delivery or download of digital files does not itself transfer copyright. Clients may download delivered photographs, share them with family, print them for personal use, and publish them on personal social media for personal use, subject to any restrictions expressly agreed before confirmation.
Commercial Use And RAW Files
Business branding, advertising and other commercial use require an appropriate license or written agreement. For commercial branding packages, we clarify the intended commercial usage rights before booking. RAW files are not included by default; any exception must be agreed in writing.
Promotional Permission And Minors
Nivya Portraits requires separate written client authorization before using identifiable photographs for marketing. Permission must distinguish the applicable channels: website portfolio, social media, paid advertising and printed promotional materials. Clients may decline without losing access to photography services. Appropriate parent or legal guardian authorization is required for minors. Copyright ownership and payment do not replace likeness permission, including restrictions concerning identifiable people in backgrounds. Contact inquiry@nivyaportraits.com to request review of restrictions or withdrawal; we discuss future use and practical removal options without promising to reverse every prior lawful use.
Policy Changes And Contact
The effective date shown on this page reflects publication of this version and is updated for material changes. We use a prominent website notice when appropriate; there is no automatic policy-change email service. Session-specific arrangements are confirmed directly in writing.
